Legal Question in Landlord & Tenant Law in California

re: subtenant rights

Hi, i moved into an apartment where there was already someone there. i was not put on the lease, but just rented out a room on a month to month basis. Now the guy who is on the lease is kicking me out and wants me out within a week (the first week of the month), even though i have already paid this months rent. do i have any legal rights? can he really kick me out immediately? isn't he supposed to give me 30 days notice?

Re: re: subtenant rights

Your question is not very clear. I need more facts. Is the "guy" a landlord, or a tenant? What reason is he giving for asking you to leave? What is your relationship? You may or may not have legal rights. In most cases, you would be entitled to 30 days' notice, and you couldn't be evicted immediately. If you e-mail me with more details, I could give you a more comprehensive answer.
