Legal Question in Landlord & Tenant Law in California
If my tenant lets his girlfriend stay for 30 days, then gone 60 days, then back 4 days do I have to serve her a 3 day notice to quit for domestic violence and assault with a deadly weapon or just a trespass notice to keep her away. She is not on the lease, and is now in jail.

If you are evicting the actual tenant, you can, and should, also serve all unknown persons who claim an interest in the rental unit and a Prejudgment Claim of Right to Possession. If you just want the girlfriend to stay away, based on her dangerous behavior, you may need a restraining order.
