Legal Question in Landlord & Tenant Law in California

Tenant rights

I am paying my rent/lease regularly on time by means of cash in the beginning but now when I am paying my landlord BY CHECK or MONEY ORDER WITH HER NAME ON IT, she got very angry to me and yesterday my landlord gave me a notice that I should vacate the house on Sept. 5, 2009. She also told me NOT to deduct the renters credit on my filing of my taxes. I think the information that I received effect her that the house is not registered in the city of San Jose to be certified for occupancy or for rental unit. Actually, because I've noticed that she enter the house even I am not home EVEN though that the lease I've signed is for the whole house. She said that she saved the one room for them to use when they visit San Jose.

SHE ALSO WROTE TO ME THAT I WILL BE LEGALLY LIABLE FOR ANY ATTORNEY FEES IF I WILL NOT COMPLY ON HER NOTICE.

My question is this: What is my remaining legal right to stay in the house because it so hard to find a rental place on this hard times, and even I am paying on time then suddenly this notice that I have received , I have to leave a certain date. Is she hiding anything illegal regsrding this house I am renting now? I really appreciate what advise you can give me , please,. Thank you very, very much. Myrna

Re: Tenant rights

I think you should pay for an attorney's time to review to see whether you may have a right to get some of your money back for an unlawful unit. If she proceeds with the eviction process, you have to have an attorney to quickly respond to any lawsuit that is filed against you.
