Legal Question in Legal Ethics in California

California attorney refuse to return the retainer fee for the legal work never performed and never worked on.

I paid attorney $5000.00 to review my case and represend me in real estate contract dispute that my original attorney was not doing any thing about it.The attorney that I paid the money never requested the file never represented me I ask in writing to ask for file never responded asked him to return the money never responded almost 4 years later I send to additional letter from attorney he refused to respond .Finaly I did find him and asked him in person to refund my money and told him he should kept in his trust account .He said he can not find my file since every thing in storage and its 4 years passed I shoud visit him in person sooner and statue of limitation applies he doesn't owe me refund.I like to know what is my legal option and its there a statue of limitation in trust fund accou - Is this your question?
