Legal Question in Medical Malpractice in California

I had a tubal ligation done about four years ago and became pregnant last year, I had been in the hospital two days before I had the baby. On the day I had the baby I was released to go home even though I still wasn't feeling well, 2 hours later I returned with pain and when they were checking the baby in my belly her heart rate had dropped alot so they had to do an emergency c-section, I asked to have my tubal done again since my form had been signed and brought to the hospital 2 weeks prior to my stay, and was signed thirty days before that date. The nurse said she couldn't find my form anywhere. They had lost that form but still had my prenatal sheets that were turned in with my consent form. So I had to wait to have my surgery done again 2 months later. What advice can I have about this matter?

Advice? That you're running out of time to take any legal action on the first tubal procedure, if there was malpractice involved in that. Other than delay, what is your claim, if any, of damage on the second tubal? Feel free to contact me to discuss your facts and whether you still have time to file any claim that may exist.

I'm sorry to hear about your suffering. It sounds like there are liability issues that need to be addressed with the Doctor and the Hospital. Perhaps we can discuss this over the phone?
