Legal Question in Medical Malpractice in California

Medical Malpractice

I believe I was the ''victim'' of med. malpractice involving several different, but related issues.I was w/ a large med. clinic from 5/2003-4/2004.I was diagnosed w/ SVT 12/2003, left the hospital & had great difficulty breathing, extreme swelling of feet & legs, Docs said it was the SVT meds Had a surg. procedure to correct SVT 3/2004, still great difficulty breathing. 1 week later had pain in my back went to a local emergency room (not my clinic) & was diagnosed w/ pulmonary embolism(PE).I believe the SVT diagnosis was incorrect & I had the PE when hospitalized 12/2003. To make matters worse the CT Scan was compared to an X-ray taken 12/2003 instead of the X-ray taken 4/2004.I went to a cardiologist for a check up re the surg. procedure & she answered lots of questions made heart illustrations did everything except listen to my heart or examine me in any way. Upon changing med ins 5/2004 doc, Scan Tech & Radiologist were horrified when they saw the X-ray & scan.Said they were useless & done wrong. There is concern as to why I developed the PE.There were no diagnostics done to determine reason for the PE by previous docs.New docs say it is very important to determine the reason; could indicate cancer. Do I have a case?

Re: Medical Malpractice

Maybe. The medical records need to be reviewed. Medical malpractice cases require a lot of thinking. 1. What were the medical mistakes, and when did they occur? 2. Were they unreasonable? 3. How was the outcome affected and to what degree of certainty? 4. Are the damages adequate to justify the risks of litigation (time and expense)? A preminary review of all records is the first step. The statute of limitations is one year for the date of discovery. These cases are taken on contingency if at all. A good lawyer will only take very strong cases because of the risks. Litigating and losing is no fun for anyone.
