Legal Question in Medical Malpractice in California

Rectal/Vaginal fistula

I recently had a low anterior resection because of rectal cancer and ten days after my surgery an intern gave me a suppository which resulted in a rectal/vaginal fistula. I had to have two emergency surgeries within a week of each other. Do I have a case for medical malpractice?

You do only if you have a doctor/expert willing to testify that this was malpractice. Without that, not only can you not win, you can't even file suit. Neither your opinion, nor mine, is relevant to the discussion. If you get such an expert opinion of malpractice, then contact me to discuss your rights and remedies. If need be, I can refer you to doctors that would consult with you. The problem is that an expert in this area charges substantial fees for consultation and testimony. Start by asking your treating physicians what their opinion is; assuming they are not the ones that did the original surgery.

A doctor would have to say that it was negligence on the nurse's hospitial's or phycian's art. Contact me directly.
