Legal Question in Personal Injury in California

accident on private property

at a store and gentleman was backing up and i made serveral attemts to get his attention but he was not paying attention. 2 passengers with him.all 3 were drinking,driver no driver license and he was not insured to operate vehicle. who do we file a small claims against.the driver and the owner of the vehicle.we did report to this to the owners insurance co. and they advised us that the driver was not insured to drive vehicle.damage was accest at @$1900.00. do we file against both?. we were supplied with driver info and owner of vehicle

The claim is against the driver and the registered owner. Make sure you file your accident report with DMV.
