Legal Question in Personal Injury in California

Possible fraudulent auto accident injury claim

My wife was involved in a three car rear end collision in which there were no reported injuries. It was determined initially, by our insurance co., that she was at fault and property damages were paid to the owners of the other vehicles. The first part of my question is (for clarification purposes), If there is a conjested line of vehicles extending to the front and the rear of your vehicle, (in this case it was morning drop off at the local high school), and you accelerate from a stop light and glance into your rear view mirror to insure that you are clear of the intersection for the sake of traffic that is making a left turn coming from the opposite direction, is it your fault when a rear end collision occurs due to the 2 cars in front of you stopping suddenly and unneccesarily? aparently, because there is a left hand turn lane about 75 yards ahead of this intersection, the vehicles in front of her had to brake to avoid colliding with cars that were slowing to merge into the turning lane, and that they were obviously following too closely and this is what caused the accident. Secondly, its been 7 months since this accident and 1 of the drivers is now claiming medical injuries. Just wondering what I should do next. Thank you.

Re: Possible fraudulent auto accident injury claim

yes, it would be her fault. turn it over to your insurance carrier if there are any claims, then don't worry. that is what insurance is for.

good luck.
