Hit & Run Collisions involving a drunk driver
Yesterday my husband was involved in a traffic collision. My husband was parked at a curbside waiting for our son to get out of school. The driver hit him from behind and fled the scene. My husband contacted law enforcement while following the suspect. Shortly after the suspect was found (asleep in the backyard against a block wall, obviously passed out)at the residence the vehicle was registered to. We are not sure if he is the registered owner of the vehicle or a family member who used the vehicle. My husbands back and neck are hurting and has had a headache since the accident occurred.He will not be going to the dr.'s until Friday which is the 3rd day after the accident. Any advice would be appreciated

Your husband will have issues with medical care, insurance coverages available and property damage. If you live in or if the the accident ocurred in Orange County, I can help organize this for you, give you the right advice and protect your rights. my best advice is to contact an attorney right away. an experienced attorney can assist your husband in getting the proper medical treatment, and in dealing with the liability and recovery issues.

Your husband should go to a doctor sooner than the 3rd. He should make it a priority. You never know what injuries accidents can cause. Also, under the permissive use statutes, the owner of the car is liable for up to $15,000 in damages. There is no cap on the driver's liability.

The advice is to get an attorney to start the process of claiming your husband's medical damages. The sooner you do so, the better the outcome. Delaying medical treatment is not a good idea, it makes it look like an afterthought. Promptly seek appropriate treatment for all symptoms. Contact me if interested in pursuing your claims.

Hopefully there is a good reason for not seeking immediate medical attention.
1. Report the matter to the police and to your own insurance carrier.
2. Do not provide statement to anyone without first consulting with an attorney.
3. Document all economic damages and out of pocket expenses incurred, including cost of medical care, medicine, lost wages, damage to your car, etc.
4. Start a diary of daily pain and its management. Your husband will not remember this important information 3-4 months down the road.
5. If your damages are not significant, you should be able to settle the case on your own. But, if your husband is badly hurt, then your best bet is hiring a competent personal injury lawyer.
6. Forgot to mention, take lots of pictures of your husband's injuries, if any. As well as the damage to the vehicles.

It is now Friday, 7:47pm. I am assuming your husband has gone to the doctor. I am also assuming you have auto insurance and have reported the claim to your insurance company, and filed a police report. The best advice I can give you at this time is to retain a competent lawyer to prosocute your case immediatly! It does not look good that your husband waited 3 days to get medical attention. The outside world would view this delay as "your husband not really being hurt." However, it will not destroy your case. What will destroy your case is saying the wrong things to the wrong people, which can be used against you at any level. You need an attorney to speak for you and get you what you are entitled to.
