Legal Question in Personal Injury in California

No Justification For Car Accident

I got into a car accident about a year and a half ago with this actress in Los Angeles. I was going to work and she made an illegal u-turn in front of me. I got injured (only soft tissue) no broken bones. I couldn't stop in time and I hit her car. My car was totalled causing me to lose my job at the time. Got myself an attorney, showed up for all the deposition appointments. She flaked on deposition four times. Lied and said she was making a left turn and I ran the light. I have pictures to prove she wasn't in intersection or making a left hand turn. Went into arbitration, and the mediator ruled in her favor. I AM UPSET, AND ANGRY because this is not justified. What should I do. No one will help me.

If it was binding arbitration, it is over. If it was non-binding, ordered by the court, you timely 'appeal' by requesting a trial de novo. If you have a valid and valuable case, attorneys would be happy to help you. However, the arbitrator didn't think you had proved your case, or disagreed with your stated version of the facts. Non-binding arbitration is always good to give the parties an opportunity to find out whether they have enough to convince a fact-finder. Your attorney can request a trial de novo if it's non-binding. However, don't be surprised if your attorney doesn't want to proceed after doing that. Perhaps now that you know how the defendant is going to attack your case, you can strategize to overcome that defense. Good luck to you.

Re: No Justification For Car Accident

If binding arbitration, you are out of luck. If not binding, you can continue your suit.
