Legal Question in Personal Injury in California
obtaining and Disseminating obscene images
Someone obtained exclusive and obscene photos of me that Only I had on my computer and posted them on a website forum - TWICE. i did the ''printscrn'' command and saved the screen(s) that had him posting the link on it. the link is a direct link to his isp's server. He is disseminating these photos of me without my consent - or permission. he also posted a FALSE AIM conversation (fake) and said it was me talking to him and i sent him the photos - which i did NOT. This is degrading and has got to be illegal. one of my friends said his ISP is Comcast. he obtained exclusive photos of me somehow, posted them on the internet on a forum i go to - TWICE, and said it was ME. What can I do about this? Who do I talk to? Can you direct me? Can you have someone contact me that CAN help me? I am completely offended and I feel degraded.

If these photographs were used and disseminated without your permission, you may certainly have a right of legal action. The nature of your legal rights will depend on how this person obtained the photographs, how they are using them, whether they are receiving any financial advantage from their use, etc.

Invasion of privacy like this would entitle you to sue. But, unless the person you are suing has sufficient assets to pay a settlement or judgment, you could end up paying attorney fees that are not recoverable. IF he has such assets and money, then it might be worth doing. IF so, feel free to contact me to discuss the facts and issues.
Re: obtaining and Disseminating obscene images
sounds pretty upsetting. you do have a claim for invasion of privacy, so long as you can show that he did not obtain and use the photos with your consent, or you have not somehow conveyed a license to publish the same. you may also have a copyright claim, but that would be ancillary.
please feel free to call to discuss.

You can sue for invasion of right of privacy and intentional infliction of emotional distress. You can also report the pictures to the ISP as copyright violations to see if they will take them off.
