My parking spot blocked, scratched my vehicle backing out who is liable?

A worker blocked my parking space in my building's garage, I thought I might have enough room, and in a hurry backing out scratched side of my car, not his. Am I liable for damage or should he be held responsible? Thank you

The blocking of your space doesn't make the other driver negligent. You're responsible for your own damage.
