Legal Question in Personal Injury in California

rear end

I was the first car of a 4 car rear end accident. Car number one hit car number two who in turn hit car number three and finally hit my car on a highway. Car number one is an uninsured motorist. What should I do? Are the other cars liable for my damages? Can I make a claim for any other cars?

hi. first, turn over any claim to, and notify your own insurance. do not, however, give a recorded statement until you are represented, as your carrier may, at some time, use it against you if you end up having to file a UM claim.

Notify your insurance company immediately. In addition to your own claim, you need to worry about being sued by some of the other drivers (who also hope to shift liability from themselves to the others involved). If you are sued your insurer should provide a defense. The insurer may also sue one or more of the other drivers on your behalf in order to recoup the amount that it pays to you.

Please note that I am not saying you would be held liable if one of the other drivers sues you. But even if you ultimately prevail, dealing with a lawsuit can be both stressful and expensive. Having your insurer involved will make things go much more smoothly for you.

Not to worry, if you have insurance, you will have uninsured motorist coverage. (It's filing a claim with your own insurance company.) Hopefully you have enough coverage to compensate you for your damages. The driver is still liable, but he may be insolvent (since he doesn't have insurance). If you have serious medical bills from injuries, then you will need an attorney to help you recover full value. If it is only damage to your car, you will handle that by turning it over to your insurance company. All the cars behind you share liability in the claim.
