Legal Question in Personal Injury in California

soccer injury

My son was in a fight during a soccer game for a youth organization. He pushed child from the other team as they walked away from each other another child ran 37 yards to tackle my child from behind. My child got top of kid and started to hit him. When my child was on top of him the referee jumped on my child back and choked him (she is an old woman 30 to 35 in age). He had to take a 2 mouth brake from the organization. when he went back to playing soccer he had pain in his back. When I took him to the doctor he had a herniated disk and a broken vertebrae. It has been a year since the fight and he has not been able to play any sports since the fight.

I agree with Mr. Cohen and Mr. Nelson. I'm also curious why a person old enough to have a child in a youth soccer league considers someone between 30 and 35 "an old woman".

If you step back and look at the brawl from a distance, it appears that fault could go all the way around. If the push were in the middle of a game, perhaps the boy who ran 37 yards was partly responsible or perhaps it is normal horseplay that comes with the territory. Perhaps the official was responsible for the injuries. Then again, since your son went back to playing soccer, perhaps he caused more damage to his back. It might be very difficult to find a lawyer who could develop a winning theory.

Seems he shouldn't have pushed the other kid to start with; better manners would have avoided the whole situation. Because of comparative guilt amongst the two brawlers, and the possibly justified action of the ref in trying to stop a continuing assault and battery, you will have difficulty proving a case and finding an attorney, for a lot of reasons, legal, practical and financial.
