Legal Question in Sexual Harassment in California
Videotaped by a third party, while at work.
Hello, I live in California, and while at work I, and a few other of my female co-workers were videotaped by a man that doesn't work for the company. I help to rehabilitate people with brain injuries, and the person recording is one of the patient's sons. He will place the camera in conspicuous places, such as the patient's bedroom, and places in the immediate residence. like the living room. there are other clients that share this same living space as well. He has been asked if he is recording and has said that he is not, even though the recorder is on, and recording. He claims to be using it to track his mother's progress, however, the company i work for has cameras in the common areas of the living quarters, and most of the film on the video is of other female workers, or other female clients in the facility, to say the least, he is really creepy. My question is, does he have to have consent from the other employees, the other clients that share the apartment, or the company itself, and if he does, what legal recourse can i take.

If the cameras are disclosed, and not in dressing areas or bathrooms or other places of privacy, then a 'company' can record employees. If this guy 'doesn't work for the company' and isn't their agent, he probably has no right to do so. Complain to the company. If they give you no remedy or satisfaction, contact an attorney.
