Legal Question in Traffic Law in California
Right to a speedy trial - speeding ticket......
I was ticketed for 80mph in the carpool lane on a posted 65mph maximum. I am guilty - I was speeding. Ticket date from CHP is 4-28-07 - original court date was 7-14-07 but got a change in the mail for 8-14-07. Can I fight this based upon my arraignment/court date being greater than 45 days?
I was also told that arraignment is when you sign the ticket as the officer shows up at your court date as witness. Is this true? TIA.

It is probable that the court will find good cause for the delay. But you can ask.
