I cannot figure out exactly what you mean by "baby is positive" and "I am negative." Does this mean that the baby was born HIV positive? This would not be enough for them to take your child away from you. There must be other circumstances, your conduct, your financial situation, etc. In any case you can put in a petition for guardianship naming your mother but, if Child Protective Service believes your mother is a danger to your child they will fight you in court. The best idea is for your mother to convince Child Protective Services that she is the best person to take care of the child. Generally speaking, Child Protective Services looks at the family members to place the child with so you have a good chance.
