First, to answer oyur question fully an attorney would need to see the relevant documents establishing your claim or right to an inheritance. Was this a Probate? Or a distribution from a living Trust? As a general proposition, if they had a fiduciary duty to make a distribution that may be an on-going tort and that would enable you to pursue a claim. However, there may be other facts, including notice to you, that may limit your right to sue. Bottom line is that you have waited 5 years and I would urge you not to wait any longer but to meet with an attorney as soon as possible to go over your rights and remedies.
