Legal Question in Workers Comp in California

Employer may be closing their doors

I have 3 WC cases filed for injuries I received on the job; 1 injury has required two surgeries. At present, I am back at work waiting to have my 2nd surgery. Just been informed that our company may close it's doors due to Budget Cuts. How will this affect my WC cases and settlements. Should I schedule my surgery before the doors close?

You should be more concerned if the workers' comp carrier was shutting down, unless your employer is self insured. Otherwise, the carrier should continue to defend itself against you in the absence of your employer.

Notice the last sentence in the paragraph above. "defend itself against you." That's right. Although you are in fact receiving medical care, at the end of the day, the carrier will only look out for it's own interest, and not the injured workers.
