Legal Question in Family Law in Colorado

broken engagement

Do I have to return the engagement ring if the engagement is broken? I know that some states require that. We got engaged in HI, lived in CO together for a year, now I am in a different state and he is still in CO. Thank you for your help!

I am not sure whether CO law or HI law would apply, though I would be inclined to say CO law, since you last lived together as an engaged couple here. CO also follows the same rule as that set out by Mr. Pearsall. If you broke the engagement, then you are to return the ring. If he broke the engagement, it is yours to keep.

I am only qualified to give legal advice concerning Rhode Island Divorce & Family Law. It is not clear which law will apply in your case. It seems that the law in HI will apply since that is where the ring was given. Under RI Law, if he broke off the Engagement and decided not to marry you, then you are not required to return the engagement ring.

Unfortunately I am only able to respond regarding Rhode Island law. If Rhode Island law were to apply and you are the recipient of the engagement ring and the other party broke off the engagement then generally speaking the other party has broken the contract of marriage and the ring should not have to be returned.
