I would like to sue my ex-husband for failure to contribute to an SBA loan that we are both liable for. I have been paying my half of the loan for the past year and a half, during which time he has refused to contribute. In a few weeks the loan will go into collections at the Treasury Department. The loan is unsecured and the total balance is $23,000. Is it in my interest to sue him for his half of the loan?

Is he a signer of the loan or personal guarantor? Are you the only one directly liable on the loan, absent this agreement you claim with your ex-husband? Was this agreement in writing? Was the loan taken out while you were still married?
