Legal Question in Personal Injury in Colorado
I was involved in a hit and run accident on 9/24. I was legally parked on the street sitting in the car while my husband went into a hardware store. A big SUV hit my car, the driver side front bumper, she kept driving. I got her license plate # & called the police. The plate # matched the description I gave of the vehicle. The officer went to her home but she was not there so it was turned over to a detective. He called me & asked me the details which I gave to him. In a few days he called and gave me the name of the driver, her address, insurance company including policy #. He said she saw damage of her vehicle but didn't realize that she hit me. She was given a ticket. I called her insurance to report it to them. They said they won't pay until they hear her side of what happened. She has been avoiding them. The adjuster with her insurance has called her at work and home and has sent letters to her home and she still will not call him back. So because of that they won't pay to have my car fixed even though she admitted to the detective that she was driving and she got a ticket. I've tried to get them to call the detective but they say they have to talk to her. My insurance can try to fight it for me but I have to pay the deductible. Is there anything else I can do? Thanks
