Legal Question in Real Estate Law in Colorado

Have a lien removed from my home

A lien was placed on my property in the fall of 1998 for some money owed to a company. One year later, the company went bancrupt and the loan was not assigned to another company. This has been verified at the county courthouse.

The bancruptcy trustee told me I needed to hire a lawyer in order to have the lien removed.

What is involved, what are the approximate costs, and how do I find a lawyer in my area that can help me with this?

Re: Have a lien removed from my home

I surmise from your question you inferred from your conversation with the trustee that he would not resist an action you initiate to cause the lien to be removed. I am skeptical; however, assuming your inference is valid, the most practical way for you to remove the lien, is to offer some token payment to the trustee in exchange for a release of the lien. You don't give any numbers, but if the trustee will accept anything less than what an attorney would charge you to litigate the matter, you would be well advised to pursue this avenue, provided this amount is less than the amount necessary to discharge the indebtedness in full. You need an attorney experienced in real estate title matters.
