Getting unwanted family removed from home

Currently the situation is this: my grandparents have been ''helping'' my brother and allowing him to stay at their home free. They are now in danger of losing their home. My husband and I have agreed to move into their home, and take over the bills. My name has been added to the deed with rights of survivorship. My brother has been in and out of bouts with the law, he steals, and does all sorts of illegal activity. He also has done a lot of damage to the home when he has his ''fits'' punching holes into walls, doors and even a window. We told him in November that he needs to be out by February. It is now January and he has no intentions on leaving until at least this summer. He was told by a police officer that because he has been a resident of the home for over 4 years that he does not have to leave. We want him out! What legal rights do I have? I have been on the deed since August 2004, so therefore I've been 1/3 owner for over 4 years also. My husband and I were discussing having him sign a paper saying what he agrees to and what not. Will that be something I can use to show in court if need be? Should I get the paper notarized? Help please! We're supposed to move in Jan 24th with our 2 children, we don't want that enviornment!

The police officer is correct. So, you need to go to housing court in your district (at the Superior Courthouse) and file an eviction action against your brother to have him evicted. He is treated like a tenant even though he does not actually pay rent. Go to the clerk's office at the courthouse and tell them what you want to do. I am sure they can show you what papers need to be filed.
