Child Support Income

I was wondering if the income for the noncustodial parent can include any of the following for the purpose of calculating child support.

Company vehicle - paid for by company for employee use

Company gas account - paid for by company for employee use

Company cell phone - paid for by company for employee use

Vehicle Insurance - paid for by company for employee use

I will just give you my experience, based mostly on Bergen and Passaic judges, with some Morris and Essex: paystub income counts. business expenses like company car and cell phone which you use primarily for business uses, do not. This is NOT an absolute rule, and it will vary depending on the facts of your particular situation.

Next, I will tell you the same thing I tell people like you, with kids and holding down a job. You need a lawyer, someone who is experienced in divorce law, located reasonably near you. There is far too much money and grief involved here. YOur kids' lives will be affected by how this divorce is handled. Your life will be tremendously affected by how this divorce is handled. Get a lawyer.

If it fits within the IRS definition of income an item should be regarded as such. I believe that some of these items might be regarded as income for child support purposes.
