My Lawyer ignores phone calls/emails

February 2009, I hired a lawyer and paid him $5,000 retainer. I am unemployed. Since then, he has ignored my phone calls and emails, and has not done substantive work on my case. My retainer says that I must pay him another $5,000 in early March 2009, which I don't have. Has he breached his contract with me by refusing to communicate with me?

If the lawyer has in fact done no substantive work on your case, and you are dissatisfied with the services provided thus far, you could discharge him or her, demand a refund of your retainer, and hire someone else who (hopefully) will prove more attentive and resourceful with respect to your legal matter.
