Legal Question in Credit and Debt Law in Florida

Divorced/Ex-Spouse to file Bankruptcy on Joint Credit Cards

My ex-husband and I agreed to split our $40,000 debt. We spilt the payments every month. He can not conitnue making them, and has decided to file Chapter 7. I am either a Joint or Authorized user on all of the accounts. I filed Chapter 7 in 1994, and choose to pay my current debt with him. Can he still file Chapter 7, and how does this affect my credit? Thank you.

Re: Divorced/Ex-Spouse to file Bankruptcy on Joint Credit Cards

Based upon the statement of fact in your question, there is nothing improper about your 'ex' filing a ch7. Since you are a co-obligor, the creditors can chase you for payment of the entire indebtedness. Note, there is nothing to prevent you from filing a new ch7.
