Legal Question in Credit and Debt Law in Florida
motorcycle loan
My ex fiancee has the motorcycle. I have the loan. It is registered in both our names. He won't pay on the loan. He won't give me back the motorcycle so I can sell it and satisfy the loan. The police won't say they can't do anything.I tried to do a voluntary repo and he would not give them the motorcycle. I paid the down payment and several payments. What can I do?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.
You are in a tough situation. Since both names are on the registration, you can try and take the motorcycle, but this could end in some problems or even violence. You need to meet with an attorney who can review the paperwork, speak with the lender and then provide you with guidance of what may be done.
