1st offense dui
I was arrested for suspision dui went to jail never had fst or breathalizer there was no video and I never admitted I have an expensive lawyer that has done nothing and Ive got a l letter from the attorney saying that discussing my case with state attorney they want me to take a deal that is terrible in exchange for a adjudicated guilty plea and If im not willing to the state will increase charges and seek more jail time that just does not make sense to me

Hello: I just read your post and the one response. You did not ask a specific question. I can assume from what you state you want to know what you should do. You also do not state what County the case is in.
One, you don't have to have a real expensive lawyer, you should have compared several attys' retainer estimates. I would add, DUI cases do require substantial retainers because the majority of our cases require a lot of our time/work and some costs if we have hearings on the driver's license along with fighting the actual case with the State Atty.
If the State does not have much evidence against you (all I was told was you didn't take any tests), you guys are playing a game of "chicken"...waiting to see who will blink before trial. If you have a great case (your atty. should be experienced enough to give you an opinion as to that question), you should tell the State atty. you are going to trial and prepare for trial. He/she may reduce the case to a reckless driving charge (which is what we always want). If that can't happen, take it to trial.
