Legal Question in Family Law in Florida
My husband has primary custody of his 10 year old son from a previous marriage. My stepson's mother sees him every other weekend but does not pay child support or help out with any expenes. Her lifestyle choices have determined her financial circumstances that impact my stepson. For instance, she could not pay her gas bill and so for the past month or so she has had no hot water and my stepson will not take showers when he is visiting her. She also never makes him brush his teeth. I fear that, in the event, something happens to my husband, my stepson will have to go back his mother where I believe is not a good environment for him to be in. She will, more than likely, not give up parental rights willingly. Is there another alternative? Could I apply for legal guardianship?
