Legal Question in Civil Litigation in Florida
Bought an animal under false pretences
I bought a dog April 16, 2005 from a newspaper article for $500 with the assumption he came with papers. The man that sold him to me promised me papers in the mail and has not delivered. I have called him 5 times and left him messages, but he has not returned my calls. I am wondering if there is a way I can file a civil suit for half of my money back. This dog is not worth $500 without papers and I would have never bought him if I knew I wasn't getting papers. If I can't do that, could you please tell me what I can do, if there is anything I can do.

Re: Bought an animal under false pretences
You can file a small claims action to demand the papers or in the alternative half your money back. Since the amount is under $500 it is not required to be in writing, but your case would be stronger if you have any written and/or recorded evidence that he agreed and/or represented to you that the dog was to come with papers.

Unless you have it is writing don't waste your time.
