Nieghbors In Yard when we are not home
Am I liable if neighbor is bringing her child over to play in my yard on large yard toys when we are not home. Other neighbors have told us it was happening and I came home on Wednesday to find neighbor, her mother and two year old playing in the yard sitting with thier lawn chair and stoller parked in our yard. Neighbor said ''I hope you don't mind, ''she'' wanted to play on the toys ( she is two years old) Everyone is warning us to take toys out of yard, but we have small children and when thier friends come over and we monitor them while they are there. I do not want to seem like a bad neighbor either but they are new to the street and have only lived there 2 years and are know for being difficult with people.

You are potentially liable for what is called an attractive nuisance. You should take steps to stop it and/or get the toys out of the yard.

Since you are aware of their actions, you could be held liable. You must advise them not to trespass on your property.
