Legal Question in Civil Litigation in Florida

Paid for Goods/Service Never Received

In December 07 my wife and I paid someone, 100 % upfront to the tune of $1,300, to take pictures of our wedding. She showed up, took pictures and proceeded to go out of business in June 08 prior to giving us anything. We were able to get the negatives from the printshop (paid extra).

Her website states to send all receipts to her lawyer, which we are doing. I have recently found out she is now operating under a different name and location. While I don't hold out hope we will ever see our money, what recourse do we have to prevent her from doing this again?

From reading online, there are many other couples that this happened to. I just want her to pay! Thanks.

Was she operating under a corporate name or as an individual? If as an individual, you might consider suing her in small claims court. Even if you get a judgement and no money, the judgement on her record will make it hard for her to get good credit. Check first to see if she has filed for bankruptcy. If she has, forget the lawsuit. If she had a corporation and it is now disolved, don't spend your time and money to sue. You can write to the Better Business Association and just spread the word of what she did.
