Legal Question in Civil Litigation in Florida

Prejudgment states

I am anticipating receiving a large lawsuit against me.

Is Georgia or Florida a prejudgment state?

Specifically speaking about Jonesboro, Georgia and Destin, Fl.

By prejudgment I am relating to a creditors ability of

securing prejudgment on my real estate in order to secure his clients position, if I do not prevail

in the lawsuit.

Re: Prejudgment states

I know of nothing in GA that the other side can do pre-judgment. However, you should consult with a local attorney because planning is important here.

Re: Prejudgment states

Generally, it is difficult to obtain a pre-judgment security interest. However, if you transfer assets in order to avoid paying a potential judgment, you may be committing fraud.
