You can always sue; the correct questions are can you win and how much. Mr. Wagner is correct; you can't win if you were not injured and part of the reason for that is that no one will seriously consider a claim of emotional distress because you felt a stone in your mouth. If you had to go to the dentist, then you could probably settle for those costs.
