Legal Question in Employment Law in Florida

heart attack at work from stress

On June 26 2001 I had a heartattack at work after being written up for an infraction of the rules which was not legit. While in my bosses office arguing this point.I had a heart attack my job is very stressful do I have any recourse for compensation. I spent 3 days in ccu and 6days in the hospital and am off work for 1 month. They put me on short term dissability which is 60% of my pay this used to be 100% but only managers and supervisors get 100% now. I think that this is a form of discrimination

Re: heart attack at work from stress

In addition to disability insurance coverage, your heart attack may be compensable under the workers' compensation statutes. This is not an open and shut matter. You need to consult with an attorney.

The different scope of coverage provided to supervisory personnel is not discriminatory (legal sense). It may not be fair, but it is not illegal.

You should schedule a formal consultation with a lawyer. A good means of obtaining an attorney referral is by contacting your State's bar association or your local county bar association. They probably have a web site and charge a nominal fee for the referral. Most attorneys either provide a free initial consultation, or charge a nominal fee. I do not charge for the initial consultation.
