Legal Question in Employment Law in Florida

Personal Health Information

I had the flu about a week ago. My wife's employer has not allowed her to work since I was sick. I was treated by my doctor and returned back to work. Her employer however is requesting something from my doctor verifying that I did not have the ''swine flu'' before she can return to work. I have an issue with turning over my personal health information to a company that I do not work for. I and my health have no bearing on her ability to perform her job duties. She has not been sick or demonstrated any symptoms that would cause concern. Do they have a right to request this information?

Re: Personal Health Information

They are not requesting your health information, per se -- only that you did not have swine flu. They are not asking about what you did have, only that you did not have something that would be contagious. What's the big deal?
