Legal Question in Employment Law in Florida
Trade Secrets
I was General Manager of a diabetic supply company for almost 3 years. I never signed a confidentiality, non compete, non disclosure or employee agreement. I was terminated via email and told my belongings would be boxed and mailed to me.
I have gotten a few offers with people who know me throughout the business. I have started to receive harassing letters from the owners attorney accusinging me of having his customer data base and other confidential info. and accusing me of stealing trade secrets. All I have is my notebook of names and phone numbers of customers I would have to call after business hours. I have a chance to join with a competior who offers better services. Of course they are interested in the customers I have built up a repore with. Can I be sued for going with a competitor and reaching out to his customers. I dont intend to bad mouth the company, I would just like to let them know I have joined another comapny and leave the decision up to the customer to change or not.

Re: Trade Secrets
You can use your knowledge and experience and if you recall customers generally that is acceptable. However, this is a complicated area of law and it really would be best if you consulted an attorney and got a consult of perhaps an hour or so. If you would like to contact my office, I provide such consults in these areas.
