if my drain backs up in my tub and toilet and all over the floor of my bathroom in my apartment and maintance comes out to fix the problem who is responsible for cleaning up the mess that was left

Depends on why the drain backed up. Do you have small children and did they drop a toy in the toilet. If this was created by no fault of your own, then I would say the landlord is responsible for the clean up.
