Legal Question in Wills and Trusts in Florida

My father passed away 2008. Primary Heir was his wife. I am a secondary heir. My fathers residence has just gone into foreclosure, and I was served a summons on 4/14/10. Do I have any rights to said property since she has allowed it into foreclosure? Shouldn't my fathers estate have taken care of his mortgage if it states "I direct that all my legal debts be paid as soon as practicable after my death"?

It is very hard to answer this question with just the facts that you have here. For example, was the house purchased before he married his ex-wife? What do you mean by being the secondary heir? Who was the executor or personal representative of his estate? Did he have any hospital bills etc.?
