Legal Question in Wills and Trusts in Florida

heirs property

Myself and two other siblings currently live on 60 acres of heirs property. We have been paying taxes on this land over 32 years. Now the question the family now wants to take the land from us (sell it that is) Is there anything we can do. Or is the land theres to sell. There are 13 heirs to this property. Any advice would be helpful.

Re: heirs property

This gets really, really complicated, but:

First, whose name(s)is the property in? In other words, has it ever been probated and titled in your and your familys name? Or is it still titled in dead persons name? If title in your and other family members names, then what needs to be done is a "partition" where the property will probably be sold, but you will get the money out of it that you've put into it after deducting for your use of it. The rules there can be really complicated depending on the facts. If the property is still in the dead persons name, it will have to be probated first. I would strongly suggest you contact a real estate or probate lawyer for details.

Re: heirs property

You might have a claim to some or all of the property depending on the particular details of your situation.
