Legal Question in Wills and Trusts in Florida

re: can I use a paralegal to change ownership of property

We need to change ownership of property of deceased mother to children. We live in a different state than the property (it is in FL) and are not familiar with attorneys or paralegals there. Can we use a paralegal to do this if the property is under a certain amount?

Where did the mother live at the time she died? If she lived in Florida, then you will have to contact a Florida attorney regarding this matter. If she lived in Louisiana, you can have a Louisiana attorney handle it. Most likely a succession or probate proceeding will have to be filed, and you will need an attorney to do that. Hope this answers your question.

You will need to retain a Florida attorney. Only a Florida Court can change title here and statutes do require you be represented by an attorney. If the value of the property is less than $75,000 or the property was your mother's home, you will be able to use a simplified form of probate called Summary Administration. I expect that would cost you in the area of a thousand dollars. Feel free to call me or send me an email if you have any questions about this.
