Legal Question in Business Law in Georgia
Contractor payment to Subcontractor
With GA law, can a GC not pay a Sub for work if the GC has not been paid by the end-client?
In NC, where I reside, the law states that a GC CANNOT refuse to pay their Sub simply because they have not yet been paid by their client.
I am about to sign a Subcontract Agreement where the Claims and Disputes are governed by the laws of Cobb county, GA.
I live and have a main office in NC. The work will be performed in all Southeast states. My attorney is not familiar with GA law. Help?

Re: Contractor payment to Subcontractor
GA law is the same as NC law in this respect. In fact, if the sub is not paid, he can file a lien against the property owner.
