I contacted a local construction co. to repair some damage to my home. They came out and gave me an estimate on the damage and said the estimate should reflect the worse case scenario.

Several of the items listed on the estimate were not needed and the work that was done was not satisfactory.The project manager feels the work was just fine and stated that the insurance is paying for it so he expects the full amount on the estimate. I dont feel I should pay for work not actually done no matter who is paying for it. As of today, I have not sent a check to the co. I have sat down with the estimate and reviewed the actual work completed and came up with my own price which is significantly lower. Should I send a letter to the co explaining my payment and can they take me to court for the remaining bill since it was just an estimate? If they ran into probs and had to do more work, I am sure they would expect me to pay above and beyond the estimated price.

They likely have their side of the story. If they want to pursue payment, and are not satisfied with the price you came up with, they can file suit to collect, place a lien on your home, or both.
