Legal Question in Credit and Debt Law in Georgia

consumer privacy act ?

I was divorced, my wife claimed responsability of a car but i was the only one listed on the loan. She didnt pay the loan so the creditor came after me.I informed them of the divorce dicree. They then spoke with her (a third party)about making payments. She didnt pay, they garnished my pay check and ruined my credit. All of this has been over the past two years and i paid it off in may of 2002. Should this of been a voided contract since they spoke with her? Is there anything i can do now?

Re: consumer privacy act ?

I suggest that the best course is to enforce your ex-spouses obligation under the divorce decree. If the order that granted the divorce provides (though the order itself or an agreement adopted as part of the order) that your ex-spouse was to pay for the car and she did not, then she is in contempt of the order. Upon proper request, a court would most likely require her to pay you what you paid on her behalf.

This answer, though responsive to the question is general in nature. It is not designed to be and should not be relied on as your sole source of information when analyzing and resolving a specific legal issue. Each fact situation is different; the laws are constantly changing. If you have specific questions regarding a particular fact situation, I urge you to consult with competent legal counsel.
