Legal Question in Credit and Debt Law in Georgia
garnishment of wages
Can a friend that has given you money in the past without any written agreement to pay it back, garnish your wages? If so how does this process work? Example: A friend has given me around $6000.00 and in return I've bought her $5200 in furniture (which I have a receipt for) and payed her around $2200, which I have canceled checks. I also worked for her for 1 year with no pay, trying to help her make her business a success. She also financed our motercycle for us and decided to take it from me because her debt ratio was to high. I was never behind in payments nor had I missed any. The payoff on the motercycle was around $9500 and loan value on it is $16500. It was appraised by a Harley Davidson dealership at $17000. I bought this bike for $18,000 and now have nothing. Can she leagelly do this? Any answers or advise would be greatly appreciated.
Thank You,
Connie

Re: garnishment of wages
She would have to sue you for amounts allegedly owed before she could garnish your wages.

Re: garnishment of wages
A garnishment is simply a court procedure to collect a judgement. So if the person sues you and wins, then they can do a garnishment. They have to win the court case first.
