You fail to state your original agreement with the seller as far as refunds, returns, etc. If the terms of the sale were no returns or refunds, and you actually received the delivery, you will likely be charged.

You did not post information needed to answer you. If you did not order the item, it is legally a gift to you, and you could keep it at no charge. If you did order it, unless the merchant policy is to accept returns, you had no right to return it, and, if you were going to return it, you should have insured it at your expense.

It sounds like you charged an item and challenged the charge bill. It also sounds like you will lose the challenge, either because you had no right to return the item or because you will not be able to prove they received it (and in not choosing to insure it and return it properly). All challenges have to be in writing within 60 days.

Note that if they just left the package without you signing, THEY have no proof of delivery, which would have won your challenge but for the fact that you have told everyone you got it and sent it back, proving delivery to you.
