Legal Question in Credit and Debt Law in Georgia

Pharmacy mistake (?)

A Pharmacy filled a prescription with a brand name medicine. I've called the Dr.-he did not prescribe a brand name. My mom has Tricare for Life which is commonly known not pay for brand name medicines(I called them and asked). I talked to the pharmacy lady and she said there was nothing she could do--it was already filled. Is there anything I can do?

Re: Pharmacy mistake (?)

If the store nmanager does something stupid and won't help (and if he's a good manager, he will help you), call the corporate office. If they also refuse, fire the pharmacy and shop elsewhere and report the pharmacist to the state pharmacy board.

Same response as the last time you asked the question -- Was there an instruction for the Pharmacist to use generic? You say the doctor did not prescribe a name brand, but that does not mean he DID prescribe or specify the generic. It is also not sufficient to say it is "commonly known" the insurer pays for generic. If a patient wants generic, they should take responsibility to ask in advance (the doctor and pharmacist).
