Pharmacy mistake

My pharmacy filled my prescription with a very expensive name brand medicine instead of the generic version that my Tricare allows. Now they want me to pay($$) for their mistake. What can I do?

We do not know what the prescription stated, or what they were told prior to filling. If it was agreed upon in advance to use generic, point it out to them.

I agree with what the other attorney said. Especially, make sure that your physician did not order the more expensive brand name over the generic. There may be a medical reason that he ordered the brand name. If so you may be able to appeal to Tricare.
